Affiliate Agreement
Not for personal use: Your account may not be used for your own personal
purchases. Anyone caught doing this will have their account
immediately terminated and their balances will not be paid.
No revenue sharing: Affiliates may not share revenue from commissions
with customers.
No paid search engine listings: You may not run paid search engine
listings on search engines. Anyone found to be doing this will have their
account terminated and funds confiscated. Reason: our generous commission
structure is designed to compensate affiliates for bringing traffic from
their own website or newsletters. Competing search engine ads lower
our click through rates and cost us keywords. Paid listings are reserved
for Evolution-X.
Email Promotion: You may not at any time use our product or name
in association with spam or unsolicited email.
Payment: We reserve the right to change commission
rates at any time. Payments will be sent out within the first
five days of every other month via mailed check (even months).
We reserve the right to deny payment to any affiliate found in violation of this agreement.
Your balance will carry over to the next month if you do not meet
the $60 minimum payment threshold in a given month.
Cookies: Cookies will expire after 365 days. Commissions
are tracked based off cookies left on the users machine. This
means anyone you refer to our site will have to purchase within
365 days after your referral. If your referral purchases multiple
times, you will receive credit for multiple purchases so long
as it is within the 365 days of clicking on your link.
Opinions that are yours and not ours: If your site expresses
opinions on acne or other things in which a viewer might confuse it with the
opinion of Evolution-X, then you must make it clear that the opinion is that
of your own, and not that of Evolution-X.
Copyright: Evolution-X's website design, text, and
graphics belong to Evolution-X. If you hold an active affiliate
account with us, you have permission to use the design, text,
and graphics from our website for the purpose of promoting
Evolution-X and Vilantae.com. Any other use is strictly
prohibited. Please keep in mind, any material used from
our site with the purpose of promoting our site must be done
in "good taste" and should not detract from our companies
image, brand, or the way we are perceived.
Medical Advice: Nothing on our site is intended to be medical
advice. If you take information from our site, you must make it clear to
your viewers that it is not intended to be medical advice.
Aquisition fraud: Creating false acquistions in our affiliate
software is strictly prohibited. All acquistions counted must be from actual
purchases made. If it is determined that any acquistions were false, your
account may be suspended or fees not paid.
Disclaimer: To the fullest extent permitted by law, Evolution-X is
providing this site and its contents on an 'as is' basis and makes no
representations or warrenties of any kind with respect to this site or its
contents. Evolution-X nor any of its affiliates, directors, employees or
other representatives will be liable for damages arising out of or in
connection with the use of our site. This is a comprehensive limitation of
liability that applies to all damages of any kind, including (without
limitation) compensatory, direct, indirect or consequential damages, loss of
data, income or profit, loss of or damage to property and claims of third
parties.
Disputes: Each party hereby waives any right to trial by jury in
the event of controversy or claim relating to this Affiliate
Agreement. The law of the State of Tennessee shall apply
to any resulting claim or action from either party, and the
exclusive jurisdiction and venue for any proceedings brought
pursuant to this Affiliate Agreement shall be Johnson City,
Tennessee.
Good Taste: The manner in which you promote our website
must be in "good taste." If it is determined that you may
detract from the image, brand, quality, or perception of Evolution-X,
then your application may be refused or your account suspended.
If the content of your site is in any way unlawful, harmful,
threatening, defamatory, obscene, harassing or racially, ethnically
or otherwise objectionable we will refuse your application
or suspend your account. Your web site may not promote sexually
explicit materials, violence, or discrimination based on race,
sex, religion, nationality, disability, sexual orientation
or age.
Evolution-X reserves the right to deny any new affiliate
application or to suspend any existing affiliate at any time
and for any reason.
